FAQ

Arbitration, Mediation & Conciliation: common questions.

01Is mediation compulsory before filing a commercial suit?

For most commercial suits that do not seek urgent interim relief, Section 12A of the Commercial Courts Act, 2015 requires pre-institution mediation first.

02How long does an arbitration take?

Under Section 29A of the Arbitration and Conciliation Act, 1996, the tribunal must make its award within 12 months of completing pleadings, extendable by six months with consent.

03Can I get urgent protection before arbitration starts?

Yes. A court can grant interim measures under Section 9 — for example, to preserve assets or stop a breach — before or during the arbitration.
